Terms and conditions of sale
Art. 1 DEFINITIONS
1.1.1. Site' means the website shop.bianchetti.it for the sale of the Products of the "Manifatture Mario Bianchetti s. r. l." with registered office in Milan 20125, Via Edolo, 9 Italia, a company registered with the C. C. I. A. A. A. of Milan at no. 1197117 of the Companies Register, Reg. to the Court of Milan no. 250862 C. F. C. and P. I. P. 07989690156.
1.2.2. Customer' means the person who has made purchases from the Site according to the following general conditions of sale. The Client may be either the natural person acting for purposes not directly related to the professional activity, or the natural or legal person acting for purposes directly related to the professional activity carried out.
1.3.3. By' Order' we mean the request form of the goods offered for sale filled in by the Customer through the Site.
1.4.4. Products' means the goods present on the Site and offered for sale according to the following general conditions of sale.
1.5.5. Price' means the price for the sale of goods including shipping costs.
1.6.6. Contract' means a distance contract for the sale of the Products governed by these general conditions of sale.
1.7.7. Parts' means Manifatture Bianchetti s. r. l. and the Customer.
Art. 2 SALE OF PRODUCTS
2.1.1. The Products are sold according to the terms and conditions set forth in the Contract published on the Site at the time of the Order.
2.2 The Contract is concluded at the moment in which the Order confirmation is sent by' Manifatture Mario Bianchetti s. r. l.' to the e-mail address indicated by the Customer at the time of registration.
2.3.3. Prices and Products on the Site may be subject to change without notice.
Art. 3 TEMPES AND MODE OF DELIVERY
3.1 Manifatture Bianchetti s. r. l. delivers the Products to the address indicated by the Customer at the time of the Order.
3.2 The Products will be delivered as soon as they are all available and in the shortest possible time.
Art. 4 CUSTOMER' S OBLIGATIONS
4.1.1. The purchase of Products from the Site presupposes the Customer's release of the data necessary for the carrying out of the delivery activities of the Products. For the purposes of registration, the Customer undertakes to communicate correct and truthful data relating to personal details, personal addresses and in general for other information useful for the execution of the Order.
4.2.2. The Customer undertakes to pay the Price of the Products purchased and to keep a copy of the confirmation notice of the purchase order, sent by bianchetti. it to the email address communicated by the Customer at the time of registration to the site.
Art. 5 PRICE AND PAYMENT
5.1.1. Prices are expressed in euros (€) and are definitive.
5.2.2. The total resulting price at the end of the purchase procedure must be understood to include shipping costs, but not any customs duties and additional taxes on the sale necessary for the importation of the goods into foreign territory. Any additional charges relating to customs clearance operations shall be borne exclusively by the consignee of the shipment.
5.3.3. Payment of the Price must be made in full: for' cash on delivery' payments, at the time of delivery of the Products; in this case, payment can be made only in cash and is allowed only for those Orders whose delivery is made within the Italian territory; for payments by credit card, at the time of execution of the Order.
Art. 6 COPYRIGHT & MARKETS
6.1.1. The trademarks, logos and other distinctive signs of any kind used in the pages of the Site, belong to their respective owners.
6.2.2. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited.
Art. 7 RIGHT OF RECEXTING
7.1.1. The right of withdrawal, in accordance with the provisions of the article. 5 Legislative Decree. May 22,1999 n. 185 and by Legislative Decree. January 15,1992 n. 50, consists of the Customer's right to withdraw from the Contract, returning the Products purchased with consequent refund of the Price.
7.2.2. The right of withdrawal applies to natural persons acting for purposes not directly related to the professional activity that may be carried out, are therefore excluded from the law purchases made by retailers and companies.
7.3.3. The right of withdrawal is exercised by sending, within 10 working days, a written notice to the following address: Manifatture Mario Bianchetti Via Edolo 9 20125 Milano Italia. The communication may also be sent, within the same time limit, by e-mail and facsimile provided that within 48 hours is confirmed by registered letter with Acknowledgement of receipt.
7.4.4. In order to exercise the right of withdrawal, it is necessary to return the purchased Products in good state of preservation.
7.5.5. The goods must be returned to: Manifatture Mario Bianchetti Via Edolo 9 20125 Milano Italia Italy The refund of the purchase or exchange of the Product, in ordinary cases, is approximately 30 (thirty) days from receipt of the returned goods and after having verified their status.
7.6.6. The refund excludes transport costs, both for the shipment and for any replacement of goods.
Art. 8 PRIVACY
8.1.1. The data communicated by the Customer necessary for the proper execution of the Contract, will be processed in accordance with the provisions of Legislative Decree. 2003 No. 196 on the subject of' Protection of personal data'.
Art. 9 WHEN AGREEMENT
9.1.1. The Contract supersedes all contracts, agreements and understandings previously made between the Parties and, together with the Order, the general conditions relating to the use of the Site and the conditions relating to the registration service constitute the entire agreement between the Parties regarding the subject matter of the Contract.
Art. 10 COMMUNICATIONS
10.1.1. All communications between the Parties must be made in writing and sent to the other party's address indicated in the Contract and Order. Communications sent by e-mail to the other party's address indicated on the Site and in the Order shall be deemed to have been sent in writing.
Art. 11 LANGUAGE
11.1.1. The Contract of Sale is drawn up in Italian and English, in the event of discrepancies in the translation, the one drawn up in Italian shall prevail.
Art. 12 APPLICABLE AND COMPETENT STANDARD LAW
12.1.1. The Contract will be governed and interpreted in accordance with Italian laws.
12.2.2. The Court of Milan, Italy will be competent for any dispute arising from the Contract.
